Sources close to the Mel Gibson crimminal investigation are telling TMZ.com that the D.A. in L.A. is close to filing charges against Mel for Domestic Violence. However, Oksana Grigorieva will not be charged with extortion. Those same sources admit that there is enough evidence beyond a reasonable doubt that Mel committed act(s) of violence against Oksana. But not enough to convict Oksana of extortion, in spite of the fact that she told Mel she would keep the audio tapes out of the hands of the public for $15 million.
Reportedly, prior to Oksana going to the Sheriff’s Department and accusing Mel of domestic violence, Mel’s family law attorney filed a declaration in the family law case where he admitted to having slapped Oksana. This was because Gibson said that during an argument with Oksana, she was shaking baby Lucia and he was afraid she would suffer Shaken Baby Syndrome. Part of the report reads, “I slapped Oksana one time with an open hand in an attempt to bring her back to reality”.
The charges are likely to be misdemeanor domestic violence, with a maximum sentence of six months in jail.
Sources tell TMZ that the extortion investigation has come to a deadlock between the D.A. and the L.A. County Sheriff’s Department, and that investigators believe there is sufficient evidence — much of which has not been made public — to prosecute Oksana, but the D.A. doesn’t agree with that accessment.
A decision is expected to come down from the courts within the next two weeks, maybe as early as before this weekend.
